Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt Cochrane Air Services Limited, P.O. Box 1893, Cochrane, Ontario, P0L 1C0, from the requirements of subsection 700.04(1) of the Canadian Aviation Regulations, subject to the conditions set out below.
The subsection states that a Canadian is eligible to hold an Air Operator Certificate.
PURPOSE
The purpose of this exemption is to allow Cochrane Air Services Limited to hold an Air Operator Certificate while not meeting the eligibility requirements of the Canadian Aviation Regulations.
APPLICATION
This exemption applies to Cochrane Air Services Limited, P.O. Box 1893, Cochrane, Ontario, P0L 1C0, Air Operator Certificate number 3474, while operating aircraft DeHavilland DHC-2, C-FGBF, C-FEYQ, and Cessna180, C-FHID.
CONDITIONS
This exemption is subject to the following conditions:
- The aircraft are maintained and operated at all times pursuant to the requirements of subpart 703 of the Canadian Aviation Regulations.
- Cochrane Air Services Limited shall conduct the air transport service to and from Lake Lillabelle (Cochrane), Ontario and to the fifty-eight outpost camps owned and operated by Cochrane Air Services Limited and Kesegami Lake Lodge Inc. in Northern Ontario (see attachment). The air service shall operate during the period beginning March 1 and ending November 1 for each of the years 2005, 2006 and 2007.
- Cochrane Air Services Limited may operate Cessna C180, C-FHID, and DeHavilland DHC-2 CFGBF, and C-FEYQ.
- Cochrane Air Services Limited shall have a valid ORDER EXEMPTING COCHRANE AIR SERVICES LIMITED FROM THE APPLICATION OF SUBPARAGRAPH 61(a)(i) OF THE CANADA TRANSPORTATION ACT, issued by the Minister of Transport.
VALIDITY
This exemption is in effect until the earliest of:
- the date on which any of the foregoing conditions is not complied with;
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety or for cause; or
- 2359 EST on November 1, 2007.
